Kidventure Limited Terms & Conditions of Enrolment & Booking

Thank you for considering Kidventure to care for your child/ren.
We are committed to providing a safe, supportive and engaging environment where every child can learn, grow and have fun. Kidventure gratefully acknowledges the funding support provided by the Ministry of Social Development, which assists in making our OSCAR programmes accessible to children and families in our community. These Parent/Caregiver Terms & Conditions set out the rights, responsibilities and expectations of both Kidventure and parents/caregivers and form the agreement between Kidventure Limited ("Kidventure") and the parent(s)/caregiver(s) of each enrolled child.
Kidventure operates in accordance with its current Kidventure Policies & Procedures Handbook, which outlines the policies, procedures and operational standards that support the safe delivery of our programmes.
If you wish to review the Kidventure Policies & Procedures Handbook before accepting these Terms & Conditions and completing your enrolment or making a booking through AimyPlus, you must request a copy from Kidventure before proceeding. A copy of the Handbook is available on request before enrolment and at any time during your child's enrolment.
By accepting these Terms & Conditions through AimyPlus, parents/caregivers acknowledge that they have read, understood and agree to be bound by these Terms & Conditions.
Kidventure may amend these Terms & Conditions and the Kidventure Policies & Procedures Handbook from time to time to reflect changes to programme operations, health and safety requirements or other operational needs. Where changes materially affect a parent/caregiver's rights, obligations or their child's participation in the programme, Kidventure will provide reasonable notice as soon as reasonably practicable.
1. Enrolment
- Enrolment is subject to programme availability and Kidventure's assessment that it can safely meet a child's needs within its staffing structure, programme environment, available resources and operational requirements.
- Completion of an enrolment form does not guarantee acceptance into a Kidventure programme.
- Parents/caregivers must provide complete, accurate and current enrolment information, including:
- Child's full name, date of birth, school attended and residential address
- Parent/caregiver names and current contact details
- At least two emergency contacts and their contact details
- Booked days of attendance
- Names of authorised persons permitted to collect the child
- Details of any custody, parenting, protection or court orders affecting the child, together with copies of relevant documentation where applicable
- Medical conditions, allergies, medications, dietary requirements and any treatment or health support requirements
- Behavioural, developmental, learning or support needs, together with any information necessary to support the child's safety, wellbeing and participation
- You acknowledge that you have fully disclosed all information known to you that is relevant to your child's health, safety, wellbeing, behaviour, medical conditions, developmental, learning or support needs, and any other information that may affect your child's care, supervision or participation in the programme. You agree to notify Kidventure as soon as reasonably practicable if any such information changes or if new relevant information becomes known during your child's enrolment.
- Parents/caregivers must notify Kidventure as soon as reasonably practicable of any changes to enrolment information.
- Kidventure may request additional information or supporting documentation where reasonably necessary to maintain accurate enrolment records or determine whether it can safely meet a child's needs. Where Kidventure determines that it cannot reasonably provide the level of care, supervision or support required within its staffing structure, available resources or programme operations, enrolment may be declined, deferred, reviewed or suspended in accordance with these Terms & Conditions and Kidventure's Policies & Procedures Handbook.
2. Programme Bookings
- Bookings are subject to programme availability and are not confirmed until accepted by Kidventure.
- Parents/caregivers are responsible for ensuring all booking information is complete and accurate at the time of booking.
- Holiday Programme bookings are subject to Kidventure's booking requirements, including applicable booking deadlines, deposits and payment timeframes.
- Parents/caregivers are responsible for reviewing the applicable Holiday Programme Information Sheet before their child's attendance and ensuring they comply with any requirements or instructions it contains, including arrival and departure times, clothing, footwear, equipment, food, drink and other activity requirements. Where a child does not arrive with the required clothing, footwear, equipment or other items necessary for the safe participation in a planned activity, Kidventure may determine that the child is unable to participate in that activity.
- A booking request does not guarantee a place in the programme. Kidventure may decline or defer a booking where programme capacity has been reached or enrolment requirements have not been satisfied.
- Kidventure reserves the right to decline, cancel, amend or defer a booking where enrolment requirements have not been met, required information or documentation has not been provided, fees remain outstanding, or where, following consideration of the child's enrolment information, suitability assessment or support needs, Kidventure determines that it is unable to safely meet the child's needs within its available staffing levels, resources or programme operations.
3. Ongoing Enrolment & Booking Changes
- Before School Care and After School Care enrolments are ongoing. Once a child's enrolment and booking have been confirmed, their booked days will continue each school term until amended or cancelled in accordance with these Terms and Conditions.
- Holiday Programme bookings apply only to the specific holiday period booked. A separate booking request is required for each Holiday Programme and attendance at one Holiday Programme does not guarantee a place in future Holiday Programmes.
- Parents/caregivers may request changes to their child's regular bookings by providing written notice to Kidventure. Booking changes are subject to programme availability, staffing requirements and operational capacity.
- Permanent booking changes will normally take effect from a Monday unless otherwise approved by Kidventure.
- Before School Care bookings may be made or amended for individual selected weekdays and will continue each school week until changed or cancelled in accordance with these Terms and Conditions.
- After School Care bookings may be amended only by changing the child's ongoing weekly booking, cannot be amended for individual selected weekdays, and will continue each school week until changed or cancelled in accordance with these Terms and Conditions
- Casual Before School Care bookings are subject to programme availability, are not confirmed until accepted by Kidventure, cannot be amended once confirmed, and must be paid in full at the time of booking. Fees for Casual Before School Care bookings are non-refundable.
- Parents/caregivers are responsible for notifying Kidventure as soon as reasonably practicable if their child's regular attendance requirements change.
4. Fees & Payments
4.1 Programme Fees
- Kidventure's current programme fees are available on request and are published on our website and AimyPlus. All fees are inclusive of GST.
- Enrolment Fee
- An enrolment fee applies to each family upon commencement of Term Care enrolment.
- Where a family already has a current enrolment in another Kidventure programme, an additional enrolment fee will not be charged.
- Where a child is un-enrolled from Term Care and subsequently re-enrolled, a new enrolment fee will apply.
- A one-off enrolment fee also applies to families enrolling in the Holiday Programme. Where a family has already paid an enrolment fee for a current Term Care or Holiday Programme enrolment, no additional enrolment fee will be charged for subsequent Kidventure programmes.
- The applicable enrolment fee must be paid before care commences.
- Programme fees are charged based on the booked space reserved for your child and remain payable regardless of attendance, including where your child is absent due to illness, holidays, casual absences, public holidays, school activities and other personal circumstances.
- Applicable fees may include, but are not limited to:
- Enrolment Fee
- Before School Care
- After School Care
- Holiday Programme
- Casual Before School Care
- Holiday Programme Deposits
- Late Collection Fees
- No Notice of Absence Fees
- Other fees approved and published by Kidventure from time to time
- Kidventure reserves the right to review and amend programme fees. Reasonable notice will be provided before any fee changes take effect.
4.2 Payment of Fees
General Payment Requirements
- Fees are payable in accordance with Kidventure's current fee schedule.
- Fees are charged for the child's booked place and remain payable irrespective of attendance, including absences due to illness, holidays, public holidays, school activities or other absences, unless otherwise stated in these Terms and Conditions.
- Payment may be made by internet banking or cash.
- Kidventure recommends that parents/caregivers establish an automatic payment to assist with maintaining their account one week in advance.
Term Care Fees
- Where a family's fees after any approved Work and Income New Zealand (WINZ) subsidy are less than $25.00 per week, the fees for the entire school term must be paid in full no later than one week before Term Care commences. If payment is not received, the child will not be permitted to attend until all fees due have been paid.
- Where a family's fees after any approved Work and Income New Zealand (WINZ) subsidy are $25.00 or more per week, accounts must be maintained at least one week in advance. Fees may be paid weekly, fortnightly or monthly, provided the account remains at least one week in advance at all times.
- Families who do not receive a Work and Income New Zealand (WINZ) subsidy must maintain their account at least one week in advance. Fees may be paid weekly, fortnightly or monthly, provided the account remains at least one week in advance at all times.
- Public holidays that fall on a child's regular booked Before School Care or After School Care day are payable, even though Kidventure is closed and no care is provided.
- Parents receiving a WINZ OSCAR Subsidy
- Accounts are invoiced for the applicable booking period.
- Parents/caregivers remain responsible for any fees not covered by WINZ.
- If WINZ payments are reduced, suspended, declined or cease for any reason, parents/caregivers remain liable for the outstanding balance.
- Where WINZ subsequently pays more than anticipated, any resulting credit will either be refunded or retained on the family's account, as agreed with the parent/caregiver.
- Families not receiving a WINZ OSCAR Subsidy
- Accounts are invoiced for the applicable booking period.
Holiday Programme Fees
- Non-Refundable Deposit (Bookings Made More Than Three Weeks Before Programme Commencement)
- A non-refundable deposit is required for each enrolled child to secure a Holiday Programme booking.
- The deposit will be credited towards the family's Holiday Programme invoice.
- The deposit must be paid within 7 days of receiving the invoice. If payment is not received within this timeframe, the booking may be cancelled.
- Once the non-refundable deposit has been received, the booking is confirmed.
- Where a family receives a Work and Income New Zealand (WINZ) subsidy, the parent/caregiver contribution is payable by the date specified on the invoice. Where no subsidy applies, the full invoice balance is payable by the date specified on the invoice.
- Bookings Made Within Three Weeks of Programme Commencement
- Full payment is required within 24 hours to secure the booking.
- Bookings are not confirmed until full payment has been received.
- Where a Holiday Programme booking is made within three weeks of the programme commencing and a family is receiving or applying for a Work and Income New Zealand (WINZ) subsidy, the invoice must be paid in full before the booking is confirmed. Once Kidventure receives the WINZ subsidy payment, the subsidy portion will be refunded or credited to the family's account.
- Where a public holiday falls during the Holiday Programme, the public holiday remains payable even though Kidventure is closed and no care is provided. As AimyPlus does not automatically include public holidays in Holiday Programme bookings, Kidventure may manually add the applicable public holiday charge to the family's account to ensure the correct programme fees are charged.
WINZ Holiday Programme Subsidies
- Where a WINZ subsidy has not been approved before the Holiday Programme commences, Kidventure may require payment of the full invoice.
- Once WINZ funding has been received, any applicable overpayment will be refunded or credited to the family's account.
- Children may not attend the Holiday Programme until all required payments have been received.
4.3 Work and Income (WINZ)
- Parents/caregivers are responsible for completing and providing all documentation required by Work and Income New Zealand.
- Kidventure will assist families by completing provider documentation and supplying information required to support subsidy applications where appropriate.
- Parents/caregivers remain responsible for ensuring applicable forms are submitted within required timeframes.
- Any delay in subsidy approval does not remove the parent's obligation to pay programme fees when due.
4.4 Overdue Accounts
- Accounts must be maintained at least one week in advance. Fees not paid by the applicable due date will be considered overdue.
- Where an account becomes overdue, Kidventure will contact the parent/caregiver to discuss payment.
- Where payment is not received, the child will not be permitted to attend the programme until the account has been brought up to date. Parents/caregivers will be responsible for making alternative care arrangements.
- Fees will continue to be charged for all booked care during any period in which attendance is suspended due to an overdue account.
- Where a parent/caregiver sends a child to Kidventure while the account remains overdue, Kidventure will not collect the child from school and the child will remain at the school office for collection by the parent/caregiver.
- Where an account remains unpaid for three weeks, Kidventure may refer the outstanding balance to Baycorp for debt collection. Any reasonable debt recovery costs permitted by law will be payable by the parent/caregiver.
4.5 Additional Fees
Parents/caregivers agree to pay any applicable additional fees and charges, including:
- A late collection fee of $10.00 per minute, per child, where a child is collected after their booked session ends or after the programme closes.
- A no notice attendance/absence fee of $15.00 per day, per family, where an absence from After School Care has not been notified before 2:00pm.
- Any reasonable debt recovery costs, including collection agency fees, where an overdue account is referred for debt collection in accordance with these Terms and Conditions.
- Any other fees or charges published by Kidventure and advised to parents/caregivers from time to time.
5. Attendance, Arrival & Collection
5.1 Attendance
- Parents/caregivers are requested to notify Kidventure if their child will be absent from:
- Before School Care before 7:30am
- Holiday Programme before 7:30am
- No notice of attendance fee is not applicable for Before School Care or Holiday Programme.
- Parents/caregivers are required to notify Kidventure if their child will be absent from After School Care before 2:00pm.
- Where an absence from After School Care is not notified before 2:00pm, a no notice attendance/absence fee may apply in accordance with these Terms and Conditions.
- Fees remain payable for all booked sessions in accordance with these Terms and Conditions, regardless of attendance, unless otherwise stated.
5.2 Arrival & Collection
- Children attending Before School Care must be accompanied to the programme by a parent/caregiver or authorised adult. Children are not permitted to arrive at the programme unattended. Children who have not arrived by 8:15am will be recorded as absent.
- Children attending the Holiday Programme who have not arrived by the arrival time specified on the Holiday Programme information sheet will be recorded as absent.
- Children remain the responsibility of their parent/caregiver until they have been signed into the programme and accepted into Kidventure's care. Responsibility transfers back to the parent/caregiver once the child has been signed out, collected by an authorised collection person, or has left in accordance with an approved independent departure arrangement.
- Parents/caregivers are responsible for ensuring their child is signed into and out of the programme. Kidventure staff may sign a child into or out of the programme on behalf of the parent/caregiver.
- Children may only be collected by a parent/caregiver or authorised collection person recorded on the child's enrolment information unless an alternative collection arrangement has been authorised by the parent/caregiver and approved by Kidventure.
- Kidventure may verify the identity and authority of any person collecting a child and may refuse to release a child where it is unable to verify the person's identity or authority, or where there are reasonable concerns for the child's safety or wellbeing.
5.3 Independent Departures
- Children will only be permitted to leave the programme independently where written authorisation has been provided by the parent/caregiver and approved by Kidventure.
- Approval of independent departures remains at Kidventure's discretion.
- Once a child has been authorised to leave independently and departs the programme at the approved time, responsibility for the child's supervision transfers to the parent/caregiver.
5.4 Failure to Collect a Child
- Parents/caregivers must collect their child by the end of their booked session or before programme closing time.
- Where a child has not been collected:
- Kidventure will attempt to contact the parent/caregiver.
- If unsuccessful, authorised emergency contacts will be contacted.
- Late collection fees may apply in accordance with Kidventure's current fee schedule.
- Where a child remains uncollected and no authorised person can be contacted, Kidventure may contact New Zealand Police or take any other action considered necessary to ensure the child's safety.
5.5 Custody & Court Orders
- Parents/caregivers are responsible for providing Kidventure with copies of any parenting orders, custody orders, protection orders or other legal documentation affecting the care or collection of their child.
- Kidventure will comply with current legal documentation provided to the programme but cannot enforce arrangements that have not been disclosed.
6. Health, Medication & Medical Emergencies
6.1 Child Health
- Parents/caregivers must ensure their child is well enough to safely participate in the programme before attending.
- Children who are unwell, have an infectious illness or require a level of care that cannot reasonably be provided within the programme's staffing levels or operations may not be accepted into care or may be required to be collected from the programme.
- Parents/caregivers agree to comply with any exclusion or stand-down periods that apply to their child's illness or infectious condition in accordance with Kidventure's Sick Child & Infectious Illness Policy.
- Kidventure reserves the right to determine whether a child is well enough to attend the programme in accordance with its Sick Child & Infectious Illness Policy.
- Programme fees remain payable where a child is absent or excluded due to illness in accordance with these Terms and Conditions.
6.2 Medication
- Parents/caregivers are responsible for providing all required medication together with completed Medication Consent Forms before care commences.
- Medication must:
- Be supplied in its original pharmacy packaging;
- Be clearly labelled with the child's name;
- Include current dosage instructions; and
- Remain within its expiry date.
- Where required medication has not been provided, has not been replaced when expired or depleted, or does not meet the above requirements, the child will not be accepted into care until the required medication has been provided. Until that time, responsibility for the child's care remains with the parent/caregiver.
- Where a child has been diagnosed as being at risk of anaphylaxis, parents/caregivers must provide a current Anaphylaxis Action Plan together with the child's prescribed adrenaline auto-injector (EpiPen or equivalent) before the child will be accepted into care.
- Medication will only be administered in accordance with Kidventure's Medication Policy and with the required consent.
- Where a child is responsible for self-administering prescribed medication (such as an asthma inhaler), parents/caregivers must advise Kidventure during enrolment and complete the appropriate consent documentation.
- Holiday Programme Medication
- Where medication is required during the Holiday Programme, parents/caregivers must provide all required medication and completed documentation before the child's first day of attendance.
- Where a child requires daily medication throughout the Holiday Programme, sufficient medication for the full period of attendance must be supplied before care commences.
6.3 Medical Emergencies
- Where a child becomes unwell or is injured while attending Kidventure, staff will provide appropriate first aid and seek medical treatment where necessary.
- Parents/caregivers will be contacted as soon as reasonably practicable.
- Where Kidventure believes urgent medical treatment is required, an ambulance or other emergency medical assistance may be arranged before a parent/caregiver can be contacted.
- Parents/caregivers acknowledge that they remain responsible for any medical costs incurred on behalf of their child.
7. Safe Participation, Behaviour & Programme Activities & Excursions
7.1 Behaviour Expectations
Kidventure is committed to providing a safe, respectful, inclusive and supportive environment where all children can participate, learn and enjoy the programme.
Parents/caregivers acknowledge that children attending Kidventure are expected to:
- Treat other children, staff, visitors and property with respect
- Follow reasonable instructions and programme rules provided by Kidventure staff
- Participate safely in programme activities and excursions
- Take responsibility for their behaviour
- Behave in a manner that does not place themselves or others at risk
- Respect the rights, wellbeing and enjoyment of others attending the programme
Kidventure uses positive behaviour guidance strategies to encourage children to develop self-regulation, responsibility and respectful relationships while maintaining a safe and inclusive environment for everyone.
7.2 Behaviour Management
- Parents/caregivers acknowledge that Kidventure may implement appropriate behaviour guidance and support strategies where a child's behaviour affects their own safety, the safety or wellbeing of others, or the safe operation of the programme.
- Behaviour guidance and support strategies will always be appropriate to the child's age, development, individual needs and the circumstances.
- Where appropriate, a child may be supported away from an activity, participate in an alternative supervised activity or group, or have other appropriate supervision or safety measures implemented to support emotional regulation, maintain safety and assist the child to successfully re-engage with the programme. These strategies are supportive behaviour management practices and are not used as punishment.
- Parents/caregivers agree to work collaboratively with Kidventure to support their child's positive behaviour, including participating in meetings, Behaviour Management Plans and other reasonable behaviour management processes where required to support the child's safe and successful participation in the programme.
7.3 Suspension & Exclusion
- Where a child's behaviour continues to present a significant risk to their own safety, the safety or wellbeing of other children or staff, or the safe operation of the programme, and Kidventure is unable to safely meet the child's needs despite implementing appropriate behaviour guidance and support strategies, Kidventure may suspend or exclude the child from the programme in accordance with its Behaviour Management Policy.
- Where appropriate and reasonably practicable, Kidventure will work collaboratively with parents/caregivers and may implement meetings, behaviour management plans or other support strategies before making a decision to suspend or exclude a child.
- Parents/caregivers acknowledge that any decision to suspend or exclude a child will be made having regard to the safety and wellbeing of the child, other children, staff and the programme's ability to safely meet the child's needs.
7.4 Participation in Programme Activities & Excursions
By enrolling their child at Kidventure, parents/caregivers provide ongoing consent for their child to participate in the planned activities offered as part of Before School Care, After School Care and the Holiday Programme, including excursions, offsite activities and transportation provided by Kidventure, throughout the duration of their enrolment unless that consent is withdrawn or amended in writing.
Programme activities may include, but are not limited to:
- Indoor and outdoor play
- Sports and recreational activities
- Creative and educational activities
- Adventure and challenge-based activities
- Local walks
- Excursions and offsite activities
- Visits to parks, playgrounds, attractions and theme parks
- Animal experiences, including farms, wildlife parks, zoos, aquariums and other approved animal-related activities
- Swimming and approved water-based activities
- Community visits and special events
- Age-appropriate use of Kidventure equipment, games and recreational resources
- Transportation provided by Kidventure in buses, vans or other approved vehicles for programme activities and excursions
Parents/caregivers acknowledge that programme activities and excursions may change due to weather conditions, operational requirements or other unforeseen circumstances. Where reasonably practicable, Kidventure will notify parents/caregivers of any significant changes to planned activities and excursions.
7.5 Transport & Travel
By enrolling their child at Kidventure, parents/caregivers provide ongoing consent for their child to travel in transport arranged by Kidventure throughout the duration of their enrolment where required for programme operations.
Transport may include:
- Kidventure bus
- Kidventure vans
- Walking school bus
- Approved vehicles authorised by Kidventure
- Emergency transport where required
Transport may be provided for:
- Before School Care and After School Care school transport
- Holiday Programme excursions and off-site activities
- Emergency situations
- Other programme-related purposes
- Parents/caregivers are responsible for ensuring their child arrives at the designated departure location by the advised departure time for Holiday Programme excursions and off-site activities.
- Where a child is not present at the designated departure location by the scheduled departure time, Kidventure cannot guarantee that the child will be able to participate in the excursion or off-site activity. Where sufficient vehicle capacity or staffing is not available after departure, the child may not be accepted into care for that session.
- No refund or credit will be provided where a child is unable to participate in a Holiday Programme excursion or off-site activity because they were not present at the designated departure location by the scheduled departure time.
- All transport will be provided in accordance with Kidventure's Transport Policy and applicable health and safety requirements.
- Parents/caregivers acknowledge that, in accordance with Kidventure's Transport Policy, there will be occasions where children are transported by one authorised Kidventure staff member. There may also be occasions where a child is the sole child passenger in a vehicle.
7.6 Swimming & Water Activities
Parents/caregivers provide ongoing consent for their child to participate in swimming and other approved water-based activities organised by Kidventure throughout the duration of their enrolment.
Parents/caregivers acknowledge that:
- All swimming and water-based activities will be conducted in accordance with Kidventure's Policies & Procedures Handbook, including applicable supervision and safety requirements
- Lifejackets or other safety equipment must be worn where required by Kidventure
- Rash shirts are compulsory for all swimming activities
- Where a child does not have a rash shirt, Kidventure will attempt to provide one. If a suitable rash shirt is unavailable, the child will be unable to participate in the swimming activity
- Participation may be restricted where Kidventure determines that it is not safe or appropriate for a child to participate
7.7 Personal Property & Digital Devices
Children are discouraged from bringing personal electronic devices, toys or other valuable items to the programme.
Where personal electronic devices are brought to Kidventure, parents/caregivers acknowledge that:
- Personal devices remain the responsibility of the child and their family.
- Kidventure accepts no responsibility for the loss, theft or damage of personal devices or other personal property.
- Personal devices must remain stored in the child's bag or be securely stored by Kidventure staff during programme hours.
- Personal devices may only be used where authorised by Kidventure staff or where required to contact a parent/caregiver or authorised collection person.
- Kidventure staff may restrict, remove and securely store a personal device where its use is inappropriate or inconsistent with Kidventure's Policies & Procedures Handbook.
- Children using Kidventure-owned devices must follow staff instructions and comply with Kidventure's Digital Communication, Social Media & Online Safety Policy.
8. Privacy, Photography & Communication
8.1 Collection and Use of Information
Parents/caregivers authorise Kidventure to collect, use, store and disclose personal information relating to the child and their family where reasonably necessary to:
- Deliver Kidventure programmes and services
- Support the health, safety and wellbeing of children
- Manage enrolment, attendance and programme administration
- Communicate with parents/caregivers
- Meet legal, contractual and regulatory obligations
Personal information will be collected through enrolment forms, attendance records, medication records, accident and incident records, communications with parents/caregivers and other information provided during the child's enrolment.
Personal information will be collected, stored, used and disclosed in accordance with the Privacy Act 2020 and Kidventure's Privacy Policy.
8.2 Information Sharing
Parents/caregivers authorise Kidventure to disclose personal information where reasonably necessary to:
- Protect the health, safety or wellbeing of a child or another person
- Obtain or facilitate medical assessment, treatment or emergency services
- Work with schools, health professionals or other agencies where authorised or legally permitted
- Meet legal, contractual or regulatory obligations
- Meet the requirements of the Ministry of Social Development, Te Kāhui Kāhu or other authorised government agencies
Kidventure will only disclose personal information where authorised, required or permitted by law, or where reasonably necessary to fulfil its duty of care.
8.3 Photography, Video and Digital Media
From time to time, Kidventure may take photographs and video recordings of children participating in programme activities and excursions.
Parents/caregivers acknowledge and agree that:
- Media consent preferences are recorded during the enrolment process and may be clarified or updated by agreement with Kidventure where required.
- Where media consent has been provided, Kidventure may use photographs and video recordings for approved Kidventure programme purposes, including:
- Programme displays
- Children's work displays
- Kidventure newsletters, including children's names where appropriate
- Kidventure's private Instagram page
- Photographs and video recordings will only be used in accordance with the parent/caregiver's recorded media permissions.
- Photographs and video recordings will not be published on Kidventure's website unless the parent/caregiver has provided separate consent for that purpose.
- Parents/caregivers may amend or withdraw their media permissions at any time by notifying Kidventure in writing. Changes will be applied as soon as reasonably practicable.
8.4 Parent Communication
Parents/caregivers agree that Kidventure may communicate with them using methods including:
- Email
- Telephone
- Text message
- AimyPlus
- Other communication methods or electronic platforms used by Kidventure from time to time
Parents/caregivers acknowledge that Kidventure may communicate with them regarding matters including:
- Their child's attendance, health, safety and wellbeing
- Behaviour, behaviour management strategies, behaviour management plans and incidents involving their child
- Programme updates, operational notices and service information
- Bookings, enrolment matters and programme changes
- Payment of fees, invoices, overdue accounts and payment reminders
- Other matters relating to their child's enrolment, participation or care at Kidventure
Parents/caregivers are responsible for:
- Ensuring their contact details, emergency contact information and other enrolment information remain current
- Regularly checking communications from Kidventure and responding promptly where information, consent or action is required
8.5 Access to Information
Parents/caregivers may request access to, or correction of, personal information held by Kidventure relating to themselves or their child in accordance with the Privacy Act 2020.
Requests to access or correct personal information should be made to Kidventure's management.
8.6 Confidentiality
Kidventure respects the privacy and confidentiality of all children, families and staff.
Parents/caregivers agree to respect the privacy and confidentiality of other children, families and staff attending the programme.
Parents/caregivers acknowledge that Kidventure will not disclose personal information relating to another child, family or staff member except where authorised, required or permitted by law.
9. Complaints & Concerns
Kidventure is committed to providing a safe, welcoming and high-quality programme for all children and families. We value feedback and encourage parents/caregivers to raise any concerns or complaints as soon as possible so they can be addressed promptly, fairly and respectfully.
Parents/caregivers are encouraged to discuss any concerns with the Programme Supervisor in the first instance. Where appropriate, concerns may also be raised directly with the Manager. Complaints may be made verbally or in writing.
Where possible, Kidventure will seek to resolve concerns immediately. Where this is not possible, the complaint will be managed in accordance with Kidventure's Complaints Policy.
Kidventure will:
- Acknowledge complaints within 5 working days
- Consider all relevant information before making a decision
- Manage complaints respectfully, fairly, impartially and confidentially, to the extent reasonably practicable
- Keep parents/caregivers informed of the progress and outcome of the complaint where reasonably practicable
- Maintain records of complaints and any actions taken
Parents/caregivers are expected to communicate respectfully with Kidventure staff, other children and other families at all times.
Where a complaint relates to the safety or wellbeing of a child, Kidventure will respond in accordance with its Child Protection Policy and other relevant policies and procedures. Where required, Kidventure may notify or consult with appropriate authorities or agencies.
A copy of Kidventure's Complaints Policy is available on request.
10. General Conditions
10.1 Changes to Enrolment
Parents/caregivers must notify Kidventure as soon as reasonably practicable of any changes to enrolment information, including:
- Contact details
- Emergency contacts
- Medical information
- Custody, parenting or court orders
- Authorised collection persons
- Independent departure permissions
- WINZ subsidy arrangements
- Any other information that may affect the child's health, safety, wellbeing or participation in the programme
Kidventure may request updated information or supporting documentation where reasonably necessary to maintain accurate enrolment records.
Failure to provide current and accurate information may affect Kidventure's ability to safely care for the child.
10.2 Changes to Bookings
Requests to permanently change booked days or programme sessions are subject to programme availability, staffing requirements and operational capacity and are not effective until confirmed by Kidventure.
Temporary booking changes and additional casual bookings are also subject to programme availability and staffing requirements.
Kidventure cannot guarantee that requested booking changes or additional bookings will be available.
10.3 Programme Changes
Kidventure reserves the right to make reasonable changes to:
- Programme activities and excursions
- Operating procedures
- Operating hours
- Programme locations
- Staffing arrangements
- Fees and charges
- These Terms & Conditions
- The Kidventure Policies & Procedures Handbook
Where changes materially affect a child's enrolment, programme participation or a parent/caregiver's obligations, Kidventure will provide reasonable notice as soon as reasonably practicable, unless an immediate change is required for health, safety, legal, regulatory or operational reasons.
10.4 Emergency Closures & Unforeseen Events
Kidventure may temporarily close, suspend, relocate or modify programme operations where reasonably necessary due to circumstances beyond its reasonable control, including but not limited to:
- Severe weather
- Natural disasters
- Public health events
- Utility failures
- Civil emergencies
- School closures or changes to school operations
- Government directions or regulatory requirements
- Other unforeseen operational circumstances
Kidventure will make reasonable efforts to notify parents/caregivers of any changes as soon as reasonably practicable.
10.5 Parent Conduct
Parents/caregivers are expected to communicate and behave respectfully towards Kidventure staff, children, other parents/caregivers and visitors at all times.
Parents/caregivers agree to comply with Kidventure's Parent Conduct Policy. Failure to do so may result in action being taken in accordance with these Terms & Conditions, including the suspension or termination of a child's enrolment or booking where appropriate.
10.6 Personal Property & Risk
While Kidventure takes all reasonable steps to provide a safe, well-supervised and enjoyable programme, participation in programme activities and excursions carries an inherent risk of minor injury despite reasonable precautions being taken.
Personal belongings brought to the programme, including clothing, toys, electronic devices and other valuables, remain the responsibility of the child and their parent/caregiver. Kidventure is not responsible for the loss, theft or damage of personal property.
10.7 Kidventure Policies & Procedures Handbook
The Kidventure Policies & Procedures Handbook forms part of the operational framework under which Kidventure programmes operate. Parents/caregivers acknowledge that the current Kidventure Policies & Procedures Handbook is available on request and may be amended from time to time to reflect changes to programme operations, health and safety requirements or other operational needs. Where amendments materially affect a parent/caregiver's rights, obligations or their child's participation in the programme, Kidventure will provide reasonable notice as soon as reasonably practicable.
10.8 Entire Agreement
These Terms & Conditions, together with the completed enrolment information, applicable permissions and consents, and Kidventure's current fee schedule, form the agreement between Kidventure and the parent/caregiver.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
11. Parent Declaration & Agreement
By completing an enrolment and/or making a booking with Kidventure through AimyPlus, I/we acknowledge that I/we have read, understood and agree to be bound by the Kidventure Parent/Caregiver Terms & Conditions.
I/we further acknowledge and agree that:
- The information provided during enrolment is true, complete and accurate to the best of my/our knowledge
- It is my/our responsibility to ensure all enrolment information remains accurate and current throughout my/our child's enrolment and to promptly notify Kidventure of any changes
- I/we understand that programme fees remain my/our responsibility, including where fees are partially funded through Work and Income New Zealand (WINZ) or any other third party
- I/we authorise Kidventure to obtain emergency medical treatment for my/our child where it is considered necessary and acknowledge responsibility for any associated costs
- I/we provide ongoing consent for my/our child to participate in Kidventure's planned programme activities and excursions, and approved transport arrangements throughout the period of enrolment
- I/we acknowledge that Kidventure may communicate with me/us regarding my/our child's enrolment, attendance, health, safety, wellbeing, behaviour, programme participation and payment of fees using the contact details provided
- I/we agree to communicate respectfully with Kidventure staff, other parents/caregivers, children and visitors and to comply with Kidventure's Parent Conduct Policy.
- I/we understand that Kidventure reserves the right to suspend, withdraw or terminate my/our child's enrolment or booking in accordance with these Terms & Conditions
- I/we acknowledge that these Terms & Conditions, together with the completed enrolment information, applicable permissions and consents, and Kidventure's current fee schedule, form the agreement between Kidventure and the parent(s)/caregiver(s) responsible for the enrolled child
